The State Office for Digitization, Broadband and Surveying (State Office) shall monitor the data in accordance with the provisions of Art. 8 Par. 2 sentence 1 of Directive (EU) 2016/2102 the compliance with the obligations pursuant to § 1 para. 1 sentence 3 and § 2.
Enforcement Proceedings
If a request via the contact option pursuant to Section 2 Sentence 2 remains completely or partially unanswered within six weeks, the State Office shall, at the request of the user, examine whether, within the scope of the monitoring pursuant to Para. 1 measures are required vis-à-vis the obligated party. 2Sentence 1 shall apply mutatis mutandis if the user asserts that an infringement pursuant to § 1 para. 1 sentence 3 obligated party wrongly relies on an exception according to § 1 para. 4 invokes.
